OVERVIEW
Welcome to Cuccico Design! The terms “we”, “us” and “our” refer to Cuccico Design. Cuccico Design operates this store and website, including all related information, content, features, tools, products and services in order to provide you with a curated shopping experience (the “Services”). Cuccico Design is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) together with any policies referenced herein describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and by our Privacy Policy (see “Privacy Policy”), Shipping Policy (see “Shipping Policy”), and Returns & Refunds Policy (see “Returns & Refunds Policy”). If you do not agree, do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your place of residence and you consent to the use of the Services by any minor dependents on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, shipping). You warrant that such information is accurate and complete and that you have rights to provide it. You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account.

SECTION 2 – OUR PRODUCTS (MADE-TO-ORDER)
Many items are made to order (print-on-demand). We aim to represent products accurately; however, colors/appearance may vary due to device settings and materials. We do not warrant that any product will meet personal expectations. Product descriptions and availability may change without notice; we may discontinue products or limit quantities by person, region, or jurisdiction.

SECTION 3 – ORDERS
Your order is an offer to purchase. We reserve the right to accept or decline any order at our discretion. We must receive and process payment before acceptance. Please review your order carefully; we may be unable to accommodate cancellation requests once production starts (see Returns & Refunds Policy). If we do not accept, change, or cancel an order, we will try to notify you using the contact details you provided. Purchases are for personal/household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time of order and shown in your confirmation. Unless stated otherwise, prices exclude taxes, duties, shipping/handling, or import charges. Prices are displayed in Swiss Francs (CHF) unless indicated otherwise at checkout. You agree to provide current, complete, and accurate purchase and payment information and to promptly update it as needed. You represent that you are authorized to use the payment method provided and agree to pay all charges, including applicable taxes and shipping/handling.

SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or events outside our control. SECTION 6 – INTELLECTUAL PROPERTY
All content and materials on the Services (including trademarks, text, images, graphics, video, audio, and their arrangement) are owned by Cuccico Design or our licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only. Except as permitted by law, you may not copy, modify, distribute, display, perform, or create derivative works without our prior written consent. Cuccico Design names and logos are trademarks of Cuccico Design; Shopify trademarks belong to Shopify; other marks belong to their owners.

SECTION 7 – OPTIONAL TOOLS
Access to third-party tools is provided “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to third-party terms. New features/tools may be added and will be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS
The Services may link to third-party sites or include third-party content. We are not responsible for evaluating or warranting third-party materials and are not liable for any resulting harm. Review third-party terms and policies before engaging in any transaction with them.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Cuccico Design is powered by Shopify. All sales are made directly between you and Cuccico Design. Shopify is not responsible for your purchases from Cuccico Design. You expressly release Shopify and its affiliates from claims arising from or related to your transactions with Cuccico Design.

SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy (see “Privacy Policy”). Because the Services are hosted by Shopify, Shopify may collect and process personal information to provide and improve the platform. Information you submit may be processed in other countries where Shopify and our service providers operate. See our Privacy Policy for details.

SECTION 11 – FEEDBACK
If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback in any medium for any purpose. You represent that you own or control rights in your Feedback, have disclosed any incentives, and that your Feedback complies with these Terms. We may monitor, edit, or remove Feedback at our discretion.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
Information on the Services may contain errors or omissions (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update information or cancel orders if information is inaccurate at any time without prior notice (including after you submit an order).

SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes. You agree not to, among other things: violate laws; infringe IP rights; harass or harm others; transmit false or misleading information; send spam; upload malware; scrape the Services; impersonate others; or interfere with security features. We may suspend or terminate access for violations.

SECTION 14 – TERMINATION
We may terminate or suspend access to the Services at any time in our sole discretion. You remain liable for amounts due up to the date of termination. Provisions that by their nature should survive termination shall survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy).

SECTION 15 – DISCLAIMER OF WARRANTIES
Except as expressly stated by Cuccico Design, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow certain disclaimers; if so, they may not apply to you.

SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cuccico Design and its partners, officers, employees, agents, contractors, service providers, and licensors (and Shopify and its affiliates) shall not be liable for indirect, incidental, special, consequential, punitive, or similar damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility. Our aggregate liability shall not exceed the amount you paid for the product(s) giving rise to the claim.

SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Cuccico Design, Shopify, and their affiliates, officers, employees, agents, contractors, licensors, and service providers from claims and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or third-party rights, or use of the Services. We will notify you of indemnified claims and may control the defense; you agree to cooperate.

SECTION 18 – SEVERABILITY
If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will continue in effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right is not a waiver. These Terms and the policies referenced herein constitute the entire agreement between you and us regarding the Services, superseding prior agreements. Ambiguities will not be construed against the drafting party.

SECTION 20 – ASSIGNMENT
You may not assign these Terms or any rights/obligations without our prior written consent. We may assign or delegate these Terms without notice.

SECTION 21 – GOVERNING LAW
These Terms and any disputes are governed by the laws of Switzerland. You and Cuccico Design consent to the jurisdiction of courts located in Switzerland.

SECTION 22 – HEADINGS
Headings are for convenience only and do not limit these Terms.

SECTION 23 – CHANGES TO TERMS OF SERVICE
We may update these Terms from time to time by posting a new version on this page and updating the “Last updated” date. Material changes will be notified as required by law. Your continued use of the Services after changes constitutes acceptance.
